According to the appellant, the charge-sheet was filed with a deliberate false statement by the respondent herein. The  appellant, therefore, prayed in his complaint as follows:
“It is, therefore, prayed that this Ho’ble Court may pleased to take this complaint on file, try to the accused U/s, 193 IPC for deliverately giving false evidence in the court as against the complainant, and punish the accused and pass such further or other orders as this Hon’ble deems fit and proper.”

191. Giving False evidence – Whoever, being legally bound by oath or by an express provision of law to state the truth, or being bound by law to make a declaration upon any subject, makes any statement which is false and which he either knows or believes to be false or does not believe to  be true, is said to give false evidence.

Section 211 of IPC: deals with an offence of instituting or causing to be instituted any criminal proceeding or falsely charging any person of having commited an offence even when there is no laful ground for such proceeding to the knowledge of the person instituting or causing the institution of criminal proceedings.
